I agree, he can do what he likes.
It also kinda looks photoshopped to me, could just be me though

Just curious, what does redding the eyes have anything to do with it? The camera does it by itself.

Well, whether it's a fake picture or not, it can be easily faked using photoshop cs4. I'm a video game design student & use photoshop a lot when doing designs, & something like adding in some smoke effects, redding up the eyes, & placing a cig in between fingers is actually REALLY easy to do. You just need to learn the controls in photoshop. So the picture could've been easily faked, most definitely.
